Terms of Service

§1. Definitions

• Provider — ONLY Marketing, Sky Tower, ul. Powstańców Śląskich 95, 53-332 Wrocław, Polska, NIP {{NIP}}, REGON {{REGON}}.
• Website — the internet site at onlymarketing.ai including all subpages.
• User — natural person, legal entity, or organizational unit that uses the Website.
• Customer — business that books a qualification call or signs a separate agreement for marketing services.
• Setting Call — a free 15-minute phone conversation with a representative of the Provider, intended for mutual qualification.
• Main Services — provided under separate agreements: paid advertising campaigns, social media management, AI chatbot, landing page, performance consulting.

§2. General provisions

Use of the Website is voluntary and free of charge. A device with internet access and a modern browser supporting HTML5 and JavaScript is required.

The User undertakes to use the Website lawfully, in accordance with good morals and these Terms. Provision of unlawful content, attempts to circumvent security measures, automated scraping, and intentional overloading of the infrastructure are prohibited.

§3. Booking the Setting Call

Booking is made via the form at /kontakt or through the AI chatbot in the lower right corner of the Website.

To book, the User provides: full name, business email, phone number, company name, industry.

The call takes place by phone. The Provider's representative calls the User at the chosen time on the provided number. Duration: up to 15 minutes.

After a successful booking, the User receives a confirmation email with a .ics attachment to add to their own calendar.

The booking is free of charge and creates no obligation. It serves mutual qualification and information exchange.

§4. Cancellation and rescheduling

The User may cancel or reschedule the appointment free of charge until the call begins. Replying to the confirmation email or contacting hello@onlymarketing.ai is sufficient.

The Provider reserves the right to reschedule in exceptional cases (illness, technical issue) and will propose a near-term alternative.

§5. Main Services and separate agreements

These Terms do not cover the provision of Main Services (paid advertising, social media, AI chatbot, landing page, performance consulting).

Cooperation on Main Services is governed by a separate agreement signed individually with the Customer after the Setting Call. The agreement specifies scope, schedule, fee, term, and termination conditions.

For Main Services, the guarantee described on the homepage applies ("first paid lead within 14 days or full retainer refund"). Guarantee details are part of the Customer agreement.

§6. Complaints

Complaints about the Website or the Setting Call may be submitted electronically to hello@onlymarketing.ai.

A complaint should include: name, email, description of the problem, and date of the incident.

We respond within 14 business days of receipt.

§7. Right of withdrawal (consumers)

The Setting Call is provided free of charge and creates no payment obligation. The right of withdrawal from distance contracts under the Polish Consumer Rights Act of 30 May 2014 has no practical application here.

For Main Services governed by separate agreements, any right of withdrawal is described in that agreement.

§8. Liability

The Provider exercises due diligence to keep the Website operating without interruption. We do not accept liability for outages caused by independent vendors (Vercel, Supabase, Google, Resend, Anthropic) or force majeure.

Responses produced by the AI chatbot are generated automatically and are auxiliary in nature. They do not constitute legal, tax, or investment advice; the User makes business decisions at their own responsibility.

§9. Copyright

All content of the Website (text, graphics, trademarks, source code) is protected by copyright and is owned by the Provider or relevant third parties.

Copying, modifying, distributing, or commercially exploiting the content without the express consent of the Provider is prohibited.

§10. Personal data

Personal data processing related to use of the Website is described in the Privacy Policy at /polityka-prywatnosci.

§11. Final provisions

The Provider may amend these Terms for valid reasons, in particular due to technical changes to the Website or changes in law. Amendments take effect 14 days after publication of the new version, unless mandatory law requires a shorter period.

Matters not covered by these Terms are governed by Polish law, in particular the Civil Code, the Act of 18 July 2002 on the Provision of Electronic Services, and GDPR.

The parties will seek to resolve any dispute amicably. Failing that, the court competent for the Provider's registered office shall have jurisdiction.
